Privacy Notice

In terms of the provisions of the Federal Law for the Protection of Personal Data in Possession of Individuals, published in the Official Gazette of the Federation on July 5, 2010, and the Regulations of the Federal Law for the Protection of Personal Data in Possession of Individuals, published in the Official Gazette of the Federation on December 21, 2011 (both provisions together referred to as the "Law for the Protection of Personal Data in Possession of Individuals"), the "Law for the Protection of Personal Data in Possession of Individuals", published in the Official Gazette of the Federation on December 21, 2011, and the "Law for the Protection of Personal Data in Possession of Individuals".Law"), Operadora de Especialidades Jardines de Guadalupe S.C. (hereinafter "DHIC"), hereby establishes this Privacy Notice in accordance with the following:

Responsible.

DHIC, domiciled at Avenida Manuel J. Clouthier No. 777 B2, Col. Jardines de Guadalupe, in Guadalajara, Jalisco, Mexico, C.P. 44740, is the entity responsible for the processing of your personal data.

In charge.

DHIC has designated the Privacy Officer in charge of its privacy policy and this Privacy Notice, who can be reached at the following email address administracion@dhc.com.mxwith address at Avenida Manuel J. Clouthier No. 777 B2, Col. Jardines de Guadalupe, in Guadalajara, Jalisco, Mexico, C.P. 44740. Through the Privacy Officer you may exercise your ARCO rights (access, rectification, cancellation or opposition) and the revocation of your consent for the processing of personal data. The Privacy Officer will have the obligation to respond to your requests within a maximum period of 20 (twenty) business days.

Personal Data Collected.

DHIC collects the following personal data: (i) name; (ii) place and date of birth; (iii) sex; (iv) occupation; (v) marital status; (vi) address; (vii) e-mail; (viii) mobile and landline telephone; (ix) name, address and telephone number of person designated as family member or person responsible for emergency cases; (x) if applicable, insurance policy; (xi) Federal Taxpayers Registry Code; (xii) x-rays; and (xiii) photographs and videos that will be included in your clinical file for the purpose of determining your condition and the evolution of the dental treatment provided. The information mentioned in the previous paragraphs will be collected in our clinic. Likewise, the information mentioned in items (i), (vii) and (viii) may be collected in our web page, through our call center and in the promotional spaces (also known as stands or activations) of DHIC located in shopping malls and other establishments within Mexico and in order for a DHIC official to contact the interested party to arrange an appointment and/or send promotional information.

On the other hand, DHIC personally collects sensitive personal data from its patients, such as: (i) health status; (ii) habits and customs; and (iii) medical history (including heredofamilial history, symptoms, pathological history, health history, religion, and in some cases, when required, sexual preference).

In case of requesting or applying for DHIC financing or credit programs, financial information necessary to determine the viability of the credit, such as bank account number and corresponding institution, and credit card information, will be collected.

Personal data, particularly those that are sensitive, will be treated and stored under strict security and confidentiality standards and will be used only for the purposes related to the provision of dental services, in accordance with this Privacy Notice and the Law.

In the event that you are not able to provide the personal data required by DHIC to adequately provide you with dental treatment (and in particular those of a sensitive nature), DHIC may, without any liability whatsoever, not provide the corresponding treatment to the patient at the outset because it does not have the necessary elements to adequately comply with its obligations to you and in accordance with the applicable legislation.

Purpose of Personal Data Processing.

Personal data in DHIC's possession will be used for the following purposes: (i) to provide the dental care you require; (ii) to be stored in our database when necessary for the fulfillment of DHIC's obligations to you and in accordance with the Law and applicable legislation; (iii) to create your clinical record in accordance with applicable health and medical legislation; (iv) for consultation by dentists and assistants and DHIC staff who require access to your information for the proper provision of services (including diagnosis and treatment) to be provided by DHIC; (v) in the event that you request or apply for credit with DHIC in accordance with the terms and conditions disclosed to you, so that the area in charge may determine the viability of the credit and, if applicable, grant the credit; (vi) to comply with DHIC's regulatory obligations; (vii) for statistical purposes, improvement of our quality processes (without identifying your identity); and (viii) for purposes of advertising DHIC's services and news.

Video and recordings.

Video cameras have been installed in DHIC's facilities for security and quality purposes only, and are located at the entrances, reception and common areas. Also, as part of our continuous improvement processes and to provide our services in the best possible way, conversations and personal interviews with our staff may be recorded, which will be warned to you prior to the start of the recording and will only be stored in strict confidentiality for a period of 10 (ten) working days. You will have the right at any time to request that your interview(s) not be recorded, without affecting in any way the services to be provided by DHIC.

ARCO procedure.

To exercise your ARCO rights, you must send a request to the following e-mail address administracion@dhc.com.mxattaching the following information: (i) name and address; (ii) copy of the holder's current official identification; (iii) in case of acting on behalf of the holder of the personal data, power of attorney signed before 2 (two) witnesses or power of attorney granted before a Notary Public, including copy of the proxy's current official identification (in case the holder is a minor, copy of birth certificate and identification issued by school institution or health agency, and in case the holder is interdicted, interdiction certificate and copy of current official identification); (iv) a precise description of the personal data with respect to which you are requesting to exercise any of the ARCO rights and the reasons; (v) if applicable, document or information proving that your data are processed by DHIC; and (vi) if applicable, documentation supporting the need to rectify your personal data.

The Privacy Officer will respond within 20 (twenty) business days by email, with the understanding that he/she may require you to submit original documentation for review within 5 (five) business days of being requested to do so (but always within the 20 (twenty) business days mentioned above). If after 5 (five) business days the requested original documentation is not submitted, then the request to exercise your ARCO rights will be considered definitively terminated without liability for DHIC or the Privacy Officer.

Revocation of Consent.

The holders of personal data may at any time request the revocation of their consent, by means of a request to the DHIC Privacy Officer, who can be contacted at the following e-mail address administracion@dhc.com.mxclearly mentioning your name and the elements necessary for DHIC to identify the personal data in respect of which the revocation is required.

Transfer.

Personal data may be transferred in strict compliance with the Law and if necessary, to DHIC's parent company, credit bureaus and banking institutions (if expressly authorized and without this implying the transfer of sensitive personal data), competent government authorities and dental service providers for the elaboration of molds and other dental elements that are required for the proper provision of DHIC's services.

Safety measures.

DHIC is committed to the security of its patients' personal data and strict compliance with the Law, and has therefore established all the necessary procedures for its due safeguarding and protection, which are reviewed periodically.

Modifications and Violations.

DHIC reserves the right to modify the present Privacy Notice, which will be informed on the web page https://www.dhic.mx/ DHIC will immediately inform you by e-mail of any breach or violation of security that occurs during or after the processing of your personal data, provided that such breach affects you in any way.

Cookies.

DHIC uses cookies, web beacons and / or other technologies on our website, through which we can monitor your behavior, time and time of navigation, queries made and internet pages of origin, in order to provide better service and browsing experience. When browsing our website you will have the opportunity to disable such technologies by following the instructions provided on the website itself.
